However, it is best that you contact the Sharia Board to have an appointment for counseling. - If the husband and wife are unable to live together even after consulting some senior family members and taking advice of wise and trusted people, then the husband can divorce his wife, or the wife has the right to ask for khula (request for divorce). But as a matter of principle a woman does not have right to give talaq (divorce). When a woman asks for khula, the man should set her free on reasonable grounds and should not hurt her. - Khula is a “talaq e baen(طلاق بائن)’’. Therefore, after the period of Iddat (Waiting period) man will be free from the responsibility to provide with maintenance and accommodation - After Talaq or khula, the children will be with their mother as follows: boy till the age of seven years and girl till the age of nine years and after this period woman is bound to handover the kids to their father. إذَا تَشَاقَّ الزَّوْجَانِ وَخَافَا أَنْ لَا يُقِيمَا حُدُودَ اللَّهِ فَلَا بَأْسَ بِأَنْ تَفْتَدِيَ نَفْسَهَا منه بِمَالٍ يَخْلَعُهَا بِهِ فإذا فَعَلَا ذلك وَقَعَتْ تَطْلِيقَةٌ بَائِنَةٌ وَلَزِمَهَا الْمَالُ... وَيَسْقُطُ الْخُلْعُ وَالْمُبَارَأَةُ كُلُّ حَقٍّ لِكُلِّ وَاحِدٍ على الْآخَرِ مِمَّا يَتَعَلَّقُ بِالنِّكَاحِ(الفتاوى الهندية: الْبَابُ الثَّامِنُ في الْخُلْعِ وما في حُكْمِهِ) وَكَذَا لَا تَقَعُ الْبَرَاءَةُ عن نَفَقَةِ الْوَلَدِ وَالرَّضَاعِ من غَيْرِ شَرْطٍ فَإِنْ شَرَطَ الْبَرَاءَةَ عن ذلك فَإِنْ وَقَّتَ لِذَلِكَ وَقْتًا جَازَ(الفتاوى الهندية: الْبَابُ الثَّامِنُ في الْخُلْعِ وما في حُكْمِهِ) قَيَّدَ بِالطِّفْلِ وهو الصَّبِيُّ حين يَسْقُطُ من الْبَطْنِ إلَى أَنْ يَحْتَلِمَ وَيُقَالُ جَارِيَةٌ طِفْلٌ وَطِفْلَةٌ كَذَا في الْمُغْرِبِ وَبِهِ عُلِمَ أَنَّ الطِّفْلَ يَقَعُ على الذَّكَرِ وَالْأُنْثَى وَلِذَا عَبَّرَ بِهِ لِأَنَّ الْبَالِغَ لَا تَجِبُ نَفَقَتُهُ على أبيه إلَّا بِشُرُوطٍ نَذْكُرُهَا وَقَيَّدَ بِالْفَقِيرِ لِأَنَّ الصَّغِيرَ إذَا كان له مَالٌ فَنَفَقَتُهُ في مَالِهِ(البحر الرائق: النَّفَقَةُ وَالسُّكْنَى وَالْكِسْوَةُ لِوَلَدِهِ الصَّغِيرِ الْفَقِيرِ) وَالْأُمُّ وَالْجَدَّةُ أَحَقُّ بِالْغُلَامِ حتى يَسْتَغْنِيَ وَقُدِّرَ بِسَبْعِ سِنِينَ وقال الْقُدُورِيُّ حتى يَأْكُلَ وَحْدَهُ وَيَشْرَبَ وَحْدَهُ وَيَسْتَنْجِيَ وَحْدَهُ وَقَدَّرَهُ أبو بَكْرٍ الرَّازِيّ بِتِسْعِ سِنِينَ وَالْفَتْوَى على الْأَوَّلِ وَالْأُمُّ وَالْجَدَّةُ أَحَقُّ بِالْجَارِيَةِ حتى تَحِيضَ وفي نَوَادِرِ هِشَامٍ عن مُحَمَّدٍ رَحِمَهُ اللَّهُ تَعَالَى إذَا بَلَغَتْ حَدَّ الشَّهْوَةِ فَالْأَبُ أَحَقُّ وَهَذَا صَحِيحٌ (الفتاوى الهندية: الْبَابُ السَّادِسَ عَشَرَ في الْحَضَانَةِ)
